These Terms form a contract between you and TechInMotion360 LLC. By creating an account, listing or purchasing items, or using any feature of the marketplace, you agree to these Terms and to the policies referenced here. If you do not agree, do not use the services.
1) Overview and contract These Terms form a contract between you and TechInMotion360 LLC. By creating an account, listing or purchasing items, or using any feature of the marketplace, you agree to these Terms and to the policies referenced here. If you do not agree, do not use the services.
2) Key definitions Buyer means a user who purchases goods or services. Seller means a user who lists or offers goods or services. Listing means any item, service, or digital content posted for sale. Services means the marketplace website, apps, and related tools operated by TechInMotion360 LLC. We and us mean TechInMotion360 LLC.
3) Eligibility and registration You must be at least 18. Users aged 13 to 17 may use the Services only through a parent or legal guardian’s account with supervision. You must provide accurate information and keep credentials secure. You are responsible for all activity that occurs under your account.
4) Relationship of parties and merchant of record TechInMotion360 operates a marketplace that connects buyers and independent sellers. We do not manufacture, store, or take title to items sold by sellers. Contracts of sale are between buyers and the specific seller. Sellers are responsible for their listings, fulfillment, and compliance with law.
5) Seller onboarding, listings, and accuracy Sellers must provide truthful shop identity, pricing, and availability. Listings must be complete and not misleading. Sellers are responsible for compliance with all laws that apply to their items, including safety, labeling, and import or export rules where relevant.
6) Orders, contract formation, and risk of loss A buyer’s order is an offer. A contract forms when the seller accepts, which can occur by confirmation or fulfillment. Risk of loss and title transfer between buyer and seller follow the shipping method and applicable law.
7) Shipping, delivery, and international trade Sellers are responsible for timely shipping, proper packaging, and providing tracking when used. Buyers are responsible for customs, duties, and import compliance in their jurisdiction unless the listing states otherwise. 8) Returns and refunds. If a seller offers returns or is required to do so by law, the seller must honor the stated policy and applicable consumer protections. Disputes about returns are handled under Section 18.
9) Fees, payouts, holds, and offsets
We may charge seller fees and payment processing fees as posted in our Fees page. We may place holds or reserves on seller funds to manage risk, chargebacks, or policy violations, and we may offset amounts you owe us against your payouts.
10) Taxes and marketplace facilitator
You are responsible for all taxes arising from your use of the Services. Where marketplace facilitator laws apply, we may collect and remit transaction privilege tax or sales tax on certain transactions.
11) Prohibited items and activities
You may not list items that are illegal, unsafe, infringing, deceptive, or that violate sanctions or export laws. Examples include unlawful weapons, counterfeit goods, and items banned by sanctions programs. Sellers must not transact with sanctioned parties or jurisdictions.
12) Aviation, safety, and FPV considerations
If you sell drones, parts, or services that relate to flight operations, you must comply with aviation rules that apply to your business and marketing. For U.S. operations, the FAA’s Part 107 framework governs commercial small unmanned aircraft systems. Listings and services must not encourage unsafe or unlawful use.
13) User content, licenses, and platform IP
You own the content you post. To operate and improve the Services, you grant TechInMotion360 LLC a non-exclusive, worldwide, royalty-free license to host, use, reproduce, adapt, publish, translate, distribute, and display your content in connection with the Services and our marketing of them. This license ends when your content is removed from the Services, subject to reasonable backup retention. Our trademarks and software are our intellectual property and may not be used without permission.
14) Intellectual property notices, takedown, and repeat infringers
If you believe content infringes your copyright, send a notice that meets 17 U.S.C. 512 requirements so we can act. We may remove or disable content and may terminate accounts of repeat infringers.
15) Data, privacy, and electronic communications
Our Privacy Policy explains how we collect and use data. Sellers receive buyer data solely to fulfill orders and must keep it secure and separate. We may send you service notices electronically. You consent to receive records electronically where allowed by law.
16) Access rules, security, and acceptable use
You agree not to interfere with the Services, to avoid unauthorized scraping or harvesting, and to use APIs only as permitted. You will not attempt to bypass security, introduce malware, or overload the platform.
17) Reviews and community conduct
Reviews must be based on genuine experiences, must be relevant, and must not include harassment, hate, or unlawful speech. We may remove content that violates these requirements.
18) Dispute tools between buyers and sellers
We provide tools that allow buyers and sellers to communicate and try to resolve order issues. We may, at our discretion, assist with information flows, but we do not adjudicate legal claims between users.
19) Third party services and links
The Services may contain links to sites or services we do not control. Your use of those is at your own risk and may be subject to their terms.
20) Warranties disclaimer
We provide the Services as is and as available. To the fullest extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.
21) Liability limit and damages cap
To the fullest extent permitted by law, TechInMotion360 will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim arising out of or relating to the Services is limited to the greater of 100 dollars or the total fees you paid to TechInMotion360 in the 12 months before the event giving rise to liability.
22) Indemnification
You agree to defend, indemnify, and hold harmless TechInMotion360 and its affiliates from claims, losses, liabilities, damages, and expenses, including reasonable attorneys’ fees, arising out of your content, your items, your breach of these Terms, or your violation of law.
23) Notices, governing law, and venue
We may provide notices by email, posting to your account, or posting on the site. These Terms are governed by Arizona law without regard to conflict rules, except that the Federal Arbitration Act governs Section 24. If Section 24 does not apply, the exclusive venue is state or federal courts in Maricopa County, Arizona.
24) Agreement to arbitrate, class action waiver, and opt out
You and TechInMotion360 agree to resolve any dispute related to these Terms or the Services through binding individual arbitration rather than in court. You may opt out within 30 days of accepting these Terms by emailing legal@techinmotion360.com with your account email and a clear statement that you opt out. Either party may seek relief in small claims court if eligible. You waive any right to participate in a class or representative action.
25) Sanctions screening and export controls
You represent that you are not on any U.S. sanctions list and that you will not use the Services to transact with sanctioned parties or jurisdictions. You agree to follow all applicable export and import restrictions.
26) Changes to the Services or to these Terms
We may change features of the Services and may update these Terms. If we make material changes, we will post the updated Terms with a new effective date. Continued use after the effective date constitutes acceptance.
27) Suspension, termination, and survival
We may suspend or terminate accounts or remove content that violates these Terms or our policies. Sections that by their nature should survive termination will survive, including intellectual property, fees and payouts owed, warranties disclaimer, liability limits, indemnity, dispute resolution, and governing law.
28) Severability, assignment, and entire agreement
If a term is invalid, the remainder stays in effect. You may not assign these Terms without our consent. We may assign them as part of a merger, acquisition, or asset transfer. These Terms and the policies referenced here are the entire agreement between you and us about the Services.
