TechInMotion360 LLC (“TechInMotion360,” “we,” “our,” or “us”) operates the TechInMotion360 Marketplace at TechInMotion360.com (the “Site”), including related mobile experiences, online chat, and seller onboarding portals. By using the Site, creating an account, purchasing, applying as a seller/contractor, or engaging with chat/SMS, you agree to this Privacy Policy & Notice at Collection. If you do not agree, please do not use the Site.

0) Scope, Roles & Definitions

  • Scope. Applies to customers, site visitors, prospective/active sellers and contractors, and support/chat users of the Marketplace.
  • Role. For Marketplace operations, TechInMotion360 is a business/controller. For certain tools (payments, chat, ID checks), we use service providers/processors under contract.
  • Personal Information (PI). Information that identifies, relates to, describes, or could reasonably be linked to a person or household.
  • Sensitive PI (SPI). Examples: government ID, SSN/EIN for payouts, financial account/routing (handled by processors), precise location (not collected by default).
  • “Sell” / “Share.” We do not sell PI for money. Some ad/analytics uses can be treated as “sharing” under certain state laws; see §6 for opt-outs and Global Privacy Control (GPC).

1) NOTICE AT COLLECTION — Customers (Checkout)

1.1 Categories Collected

  • Identifiers & Contact: name, email, phone, shipping/billing addresses.
  • Commercial Info: carts, orders, returns, warranties.
  • Payment Status Tokens: authorization/settlement results from PCI-compliant processors (we do not store full card numbers).
  • Internet/Network Activity: IP, device/browser, analytics/marketing events, referral/UTM.
  • Coarse Geolocation (from IP).
  • Support/Chat transcripts & attachments.
  • Inferences from your activity (e.g., saved carts, preferences).

1.2 Purposes

Order fulfillment, payments/taxes, shipping, returns, support (including chat), fraud/security, service improvement, and (where permitted) marketing/notifications. If we cannot ship as promised, we follow the FTC Mail/Internet Order Rule (consent or refund).

1.3 Retention (by category)

  • Identifiers/Contact & Commercial Info (orders/returns): up to 7 years (tax, accounting, defense).
  • Internet/Network logs & analytics: up to 24 months.
  • Chat transcripts/attachments: up to 24 months.
  • Marketing preferences: until you opt out (earlier deletion where required).

If a fixed period isn’t feasible, we keep PI only as long as needed for stated purposes or legal defense, then delete or de‑identify.

1.4 Sale/Sharing & Choices

We do not sell PI for money. Some analytics/advertising may be deemed “sharing.” Control choices via our Cookie Settings and Do Not Sell/Share links; we honor Global Privacy Control (GPC) opt‑out signals where required.

1.5 Rights (summary)

Access, delete, correct, export, opt out of targeted ads/sharing, and appeal denials (where available). Request at legal@techinmotion360.com (subject: “Privacy Request”).

1.6 SMS (if you opt in)

Recurring msgs; STOP to cancel; HELP for help; message & data rates may apply. See §14(b).

2) NOTICE AT COLLECTION — Sellers & Contractors (Onboarding/Payouts)

2.1 Categories Collected

  • Identifiers & Business Contact.
  • Professional/Commercial: store profile, listings, sales/returns.
  • Gov/Tax/Payout: EIN/SSN (as applicable), W‑9/W‑8, date of birth, government ID (where required), payout account/routing (processed by payment partners).
  • Fraud/Identity & Network Activity: device/IP, risk signals.
  • Support/Chat transcripts & attachments.

2.2 Purposes

Identity verification (KYC/AML), tax reporting (e.g., 1099 series), payouts, fraud prevention, marketplace enforcement, support, and legal compliance.

2.3 Retention

  • Tax/payout/KYC: up to 7 years (or longer if law requires).
  • Operational records: while the account is active (or up to 24 months after closure/inactivity).

2.4 Sale/Sharing

We do not sell seller PI for money and do not share KYC/tax data for cross‑context advertising. Disclosures to processors (payments, ID verification, tax, hosting, support) occur under contract. State rights apply as in §5.

3) Information Sources

  • You (forms, checkout, chat, uploads).
  • Devices & cookies/SDKs (auth/cart, analytics, fraud prevention, ads where enabled).
  • Service providers & partners (payments, carriers/trackers, identity/fraud tools, marketing performance).
  • Public or lawful sources (e.g., address normalization, sanctions lists for export controls).

Cookie/SDK uses and choices are described in §6; chat capture in §7.

4) How We Use PI

Operate and improve the Marketplace; fulfill orders/returns; process payments/taxes; provide support (email/chat); prevent fraud/security incidents; enforce policies; personalize experiences; perform analytics/QA/product development; comply with law and lawful requests; protect our rights and users.

5) Your Privacy Rights, Verification & Appeals

Available rights (vary by state): access (categories/specific pieces), correction, deletion, portability, opt‑out of sale/sharing/targeted advertising and certain profiling; appeal of denials. Submit requests to legal@techinmotion360.com (subject: “Privacy Request”). We may verify identity and request reasonable information to process your request; agents must provide proof of authority. We aim to respond within 45 days (one 45‑day extension where permitted). We will not discriminate for exercising rights. We honor opt‑out preference signals (e.g., GPC) where required.

6) Cookies, Advertising, De‑Identification & Signals

  • Cookies/SDKs. Used for login/cart, analytics, fraud prevention, and—if enabled—advertising/retargeting. Manage preferences in Cookie Settings and your browser.
  • Targeted Ads / “Sharing.” We do not sell PI for money. Certain ad/analytics uses may constitute “sharing.” Opt‑out via our Do Not Sell/Share link and GPC.
  • GPC. We honor recognized Global Privacy Control signals for qualifying jurisdictions.
  • De‑Identified Data. If we create de‑identified data, we will maintain it without re‑identifying (except for testing) and bind recipients by contract to do the same.

7) Online Chat & Support

We collect chat messages, metadata (time, browser, device), and attachments for support, quality, safety, and fraud prevention. Our chat provider acts as our processor under a data‑processing agreement. Do not share highly sensitive data in chat; for sensitive matters, email legal@techinmotion360.com.

8) Marketplace‑Specific Disclosures

  • Payments / PCI. Card payments are handled by PCI‑compliant processors; we do not store full card numbers.
  • Taxes & Reporting. We process what’s needed to calculate taxes and produce required tax forms for payouts (e.g., 1099 series), where applicable.
  • Shipping. We share order details with carriers and provide tracking.
  • User Content/Reviews. May be public; do not include PI you don’t want posted.
  • Security & Fraud. We may use identity verification, device checks, risk scoring, and anti‑abuse tools.

9) Data Security & Arizona Breach Notice

We use administrative, technical, and physical safeguards. No method is 100% secure. If we determine a “security system breach” under Arizona law, we will notify affected Arizona residents within 45 days (subject to lawful delay for law enforcement). If 1,000+ Arizona residents are affected, we will also notify the Arizona Attorney General and the three largest consumer reporting agencies.

10) Children’s Privacy

The Site is not directed to children under 13, and we do not knowingly collect their data. If we learn of such collection, we will delete it. For minors 13–15 in jurisdictions requiring opt‑in for sale/sharing, we will not sell/share without appropriate consent.

11) International Visitors (GDPR/UK GDPR)

Our services run in the United States. If GDPR/UK GDPR applies, lawful bases may include contract, legitimate interests (e.g., fraud prevention, service improvement), legal obligation, and consent (where required). You may have rights to access, correct, delete, port, restrict, or object; contact legal@techinmotion360.com.

12) Do Not Track / Global Privacy Control

Browsers may send DNT or GPC signals. We follow §6 for GPC and treat qualifying signals as opt‑out of sale/sharing where required.

13) FTC Mail, Internet, or Telephone Order Rule

If we cannot ship within the promised time—or within 30 days if no time is stated—we will seek your consent to delay or promptly refund unshipped merchandise.

14) Marketing Communications

14(a) Email (CAN‑SPAM)

Marketing emails identify our business, include our physical address, use non‑deceptive headers/subjects, and provide a working unsubscribe we honor promptly.

14(b) SMS Terms & Conditions (CTIA/TCPA) — Conspicuous

By opting in, you agree to receive recurring SMS (order updates, service reminders, promotional messages, support). Consent is not a condition of purchase.

  • Message Frequency: varies by interaction; specific limits (e.g., “up to X msgs/mo”) may be shown at opt‑in.
  • Opt‑Out/Help: reply STOP to cancel; HELP for assistance. Message & data rates may apply.
  • Privacy & Data Use (Required Language):
    • No mobile information will be shared with third parties/affiliates for marketing/promotional purposes.
    • All the above categories exclude text messaging originator opt‑in data and consent. This information will not be shared with any third parties.
    • We use your mobile number solely to deliver SMS related to your relationship with TechInMotion360 LLC, fraud prevention, and compliance.
  • Consent & Recordkeeping (TCPA/CTIA): for marketing texts we obtain prior express written consent; we log opt‑ins/opt‑outs, content, and timestamps; and we follow CTIA Messaging Principles.

15) Financial Incentives (If Offered)

We do not currently offer data‑driven financial incentives or price/feature differences. If we do, we will publish a Notice of Financial Incentive describing material terms and your right to opt out without discrimination.

16) Changes to This Policy

We may update this Policy & Notice periodically. We will post the update with a new “Last Updated” date. Your continued use of the Site indicates acceptance.

18) Governing Law; Venue (Arizona)

This Privacy Policy & Notice at Collection and any disputes arising from it are governed by the laws of the State of Arizona, without regard to conflict‑of‑laws rules. Exclusive venue lies in the state or federal courts located in Maricopa County, Arizona.
